Kanu’s Counsel Says Kanu’s Detention Violates International Law, To Petition UN

Counsel to Mr. Nnamdi Kanu, leader of the Indeginous Peoples of Biafra (IPOB), Mr Bruce Fien, said yesterday that the continued detention of the IPOB leader remained illegal, because it violated international law.

Fien, however, said he had gathered additional information from yesterday’s proceedings to be added to his petition already before the United Nations Human Rights Council.

Speaking with Arise News, Kanu’s expatriate counsel, who said the 11th hour change of the charges preferred against him, without allowing him to respond, was unconstitutional, also took a swipe at the decision to bar journalists from the proceedings, saying it was a violation of their constitutional rights.

Condemning Kanu’s abduction from Kenya without trial, he said, “There are irregularities here. I am coming from the United States, there’s no way that government could change the charge at the 11th hour without having an opportunity to respond to the new allegations.

“Before I arrived in Abuja, I traveled to Geneva, Switzerland, where there is a working group on arbitrary detention as part of the UN Human Rights Council, and based upon what transpired today, I have additional information that I will present to them, seeking an adjudication that the detention of Nnamdi Kanu is illegal under international law.”

He further stated that, “The Nigerian Constitution also has free speech provisions in section 39. I think what happened today is a violation of section 39.”

On the decision to bar journalists from covering the proceedings, he said it was a breach of their constitutional rights.

“The media has a right to observe. Moreover, under international law and in the United States, there is a constitutional right for journalists to attend, because it creates a kind of pressure putting a searchlight against corruption or intimidation and things of that sort, not only just the press out there every ordinary citizen has the right as long as there’s room to sit in a courtroom,” he said.

Reiterating his condemnation of Kanu’s abduction from Kenya by security agents without trial, he said the situation was against international law.

“That makes the detention illegal, in part, aside from other violations, but surely under any kind of due process, it’s totally illegal to kidnap someone take them without any hearing.

“They said that they had acted in collusion with the Interpol, what they haven’t said is that there was any hearing that enabled Nnamdi Kanu to dispute and you have to bring it before a judge before you are kidnapped not afterwards. The law is very clear on that score.

“He was not given any hearing before they took him there, indeed four of the seven counts that are now lodged against him. They weren’t even launched until after he had departed Kenya and was in Nigeria,” he said.

A former National Publicity Secretary of the Ohanaeze Ndigbo, Chuks Ibegbu, has accused the President Muhammadu Buhari-led Federal Government of treating bandits with kid gloves.

Ibegbu said the Buhari government was more concerned with the prosecution of Nnamdi Kanu, leader of the Indigenous people of Biafra, IPOB, and other pro-Biafra than dealing with the menace of banditry.

The chieftain was reacting to the declaration of bandits as terrorists by an Abuja Federal High Court.

Justice Taiwo Taiwo had declared banditry as an act of terrorism in all parts of Nigeria.

The Judge also outlawed the activities of some groups linked with acts of banditry and declared bandit activities as acts of terrorism.

Justice Taiwo, in a ruling on an ex-parte application filed by the federal government specifically declared the activities of the “Yan Bindiga Group and the Yan Ta’adda Group and other similar groups” in any part of the country, especially in the North West and North Central geo-political zones as “acts of terrorism and illegality”.

Reacting, Ibegbu said the decision of the Federal Government to treat banditry and Boko Haram with kid gloves is not the best way to move Nigeria forward.

According to Ibegbu: “It’s obvious that the Federal government is treating the issue of banditry with kid gloves and it’s very clear to everybody.

“Federal Government is treating them (bandits) with levity and is more concerned with Nnamdi Kanu, IPOB, and pro-Biafra agitators. Any little issue in the Southeast would be taken with all seriousness, but bandits, kidnappers, marauders, and Boko Haram are treated with kid gloves.

“This is not how to move a country forward or how to unite the country. Everybody should be treated equally.

“Those agitating are patriots. If you are agitating for something and you are not a bandit, killer, but pushing for fairness; you should not be seen as a terrorist.

“To be treating those killing and abducting people for ransom with kid gloves shows a high level of nepotism in the system.”

The Presiding Bishop, House of God Int’l Church, Athan Azubuike has claimed the Igbos will always play second fiddle and may never produce the president of Nigeria even when they have all it takes to lead the country in 2023.

The cleric said this at an event for young clergy in Owerri.

He insisted that the average Igbo man is a trader and not a politician as they do not have the skills to mobilise people at the grassroots

He said,” One thing about an Igbo man is that an average Igbo person is a trader only interested in profit-making, we are not interested in working. We are not interested in the grassroots. Once it’s a few months to elections, Igbo politicians will start visiting churches in remote villages, that is the sense of a trader, not a politician.”

”Let me be very frank with all on why Igbos may never produce a president but play second fiddle by asking who is coming out in Igbo land? You’ll tell me it’s Rochas Okorocha, Anyim Pius Anyim, Sam Ohuabunwa among others but since Pius became the Senate President, how many times have you seen him and others in Imo State. The presidency is not a local government election .”

He said,” Today, people are talking about the 2023 presidency and I ask those Igbo politicians claiming to be interested in the race what have they been doing to galvanize the grassroots.”

He further queried,” Why is it that an Igbo man is only interested in meeting people only when it’s a few months to any election. It’s arrant nonsense. If the program organized by Mezie Imo Clergy Forum today was held in Yoruba land or the North, this place will be filled with great personalities but here the reverse is the case”

” A good politician works before he shows his ambition. A good politician works before galvanizing for election, that is why I said an Igbo man is a trader, not a politician.”

“As a presidential aspirant, you need to move around, increase your horizon and coordinate with other zones even before now.”

IPOB has begun a protection racket in the Orlu and Orsu area of Imo State. The Orsu/Orlu axis is now IPOB’s enclave. My sources told me that the video of the beheading of the policemen was recorded somewhere around the axis. THREAD

For instance, bereaved families who are barely coping with the exploitative Igbo burial rites now have another burden added to their worries – pay the local IPOB cell or your burial will not hold. Period.

IPOB militiamen are now setting up checkpoints around the area. People are stopped and searched. If you work for certain government agency you could be tagged a “Sabo” (saboteur), tortured or even worse. People now pay to free their relatives apprehended by IPOB militiamen.

Due to the absence of the police in area, following IPOB’s relentless attacks on police stations, IPOB militiamen are now being called upon to settle scores and grievances.

Your guess of their methods of doing this is as good as mine.

The residents of Orsu/Orlu are caught between a rock and a hard place. A murderous militia which will stop at nothing to force obedience and an indiscipline military who only response to dissent is a brutal and indiscriminate crackdown.

Several families and individuals have lost their houses and other properties to these siamese twins of evil – the military and IPOB.

Igbo political and intellectual elites have elected to bury their heads in the sand.

While Ala Igbo is gradually but surely being destroyed.

When you speak to some of them in private they complain bitterly about Nnamdi Kanu and his gang of thugs. Publicly, they make excuses and cook up silly denial for the terrorist group.

What about your Igbo social media influences? Those ones are the worst.

They are members IPOB or not according to convenience.

Many of your social media influences who criticised IPOB’s sit-at-home and call to boycott the Anambra election were strong supporters of IPOB…

… before the election period. They were chief among those who lied that the attacks on police stations were not the work of IPOB and its militia ESN. They also pushed the false narrative that the attacks were orchestrated by DSS.

They opposed IPOB during the Anambra election because they thought a boycott of the election will aid an APC victory.

Watch them closely, after the election they have started leaning towards IPOB. Hard as they try to hide it any discerning person will see through their façade.

On a final note, those of you who are telling my uncles and cousins back home to warn me to stop tweeting about IPOB are wasting your time. I will not stop. The truth must be said, even if I am the only voice screaming it. Your insults will not stop me too.
